Terms of Service
These Terms of Service ("Terms") govern your use of the Cluster mobile application and related services ("Cluster", "we", "us", or "our") provided by Appvior. By creating an account or using Cluster, you agree to these Terms.
1. The service
Cluster helps you organize tasks, collaborate in crews, share shopping lists, and sync your data across devices when you sign in. Features may change or be added over time.
2. Eligibility
You must be at least 13 years old to use Cluster. If you are under the age required to consent in your country, you may use Cluster only with permission from a parent or legal guardian.
3. Accounts
You may sign in with Apple. You are responsible for activity on your account and for keeping your device secure. Do not share access in a way that compromises your account.
4. Your content
You retain ownership of the tasks, crew names, shopping items, and other content you create in Cluster ("User Content"). You grant us a limited license to host, store, process, and display User Content only as needed to operate and improve the service, including syncing data to your crew members when you choose to share it.
5. Acceptable use
You agree not to:
- Use Cluster for unlawful, harmful, or abusive purposes
- Attempt to access another user's account or data without permission
- Interfere with or disrupt the service, servers, or networks
- Reverse engineer or misuse the app except where permitted by law
- Upload malware or content that infringes others' rights
6. Crews and sharing
When you join or create a crew, certain profile information and content may be visible to other members of that crew. You are responsible for what you share and with whom you collaborate.
7. Availability and changes
We strive to keep Cluster available, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue features with reasonable notice when practical.
8. Termination
You may stop using Cluster at any time and may delete your account as described on our account deletion page. We may suspend or terminate access if you violate these Terms or if required for security or legal reasons.
9. Disclaimers
Cluster is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the service will be error-free or meet every use case.
10. Limitation of liability
To the fullest extent permitted by law, Appvior will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill arising from your use of Cluster. Our total liability for any claim related to the service is limited to the amount you paid us for Cluster in the twelve months before the claim, or USD $50 if you have not paid us.
11. Privacy
Our Privacy Policy explains how we collect and use information, including through analytics and crash reporting tools. By using Cluster, you also agree to the Privacy Policy.
12. Governing law
These Terms are governed by the laws of Australia, without regard to conflict-of-law principles, except where mandatory local consumer protections apply.
